1. Overview

BuildWise Pro (“we”, “us”, “our”) is a California remodeling contractor. This Privacy Policy explains what personal information we collect when you visit our website or send us a request, how we use and share it, and the choices and rights you have. It is written to meet the privacy laws of every U.S. state that has one, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, “CCPA”), and the federal Telephone Consumer Protection Act (“TCPA”) for calls and text messages.

The short version: we collect what you type into our quote form and basic usage data about your visit; we use it to contact you about your project and to run this site; we do not sell or share your information unless a form you submit says so and you agree to it; and you can ask us at any time to see, correct or delete what we hold, or to stop contacting you.

2. Information we collect

Information you give us

Contact details: your name, phone number and email address.
Property details: the city and ZIP code of the property.
Project details: the kind of work you want, the service you chose, your budget range, your timeline, what matters most to you, and anything you write in the message box.
Callback preferences: the day and time you asked us to call.
Your consent choices, including the consent to be contacted described in section 4.
Anything else you send us by phone, text, email or WhatsApp.

Information collected automatically

Your IP address, browser type, device type and operating system.
The pages you view, the form steps you complete, and the links or buttons you use, recorded as first-party events in our own database.
An approximate, county-level location derived from your connection, which we use only to name your area on the page and to route your request. We do not use a third-party location service and we do not collect precise geolocation.
Basic security signals, such as how quickly a form was filled in, used to tell a person from an automated script.

Information from other sources

We do not currently buy or receive personal information about you from data brokers or other third parties. If we later receive information from a partner contractor about the outcome of a request you asked us to share, we will treat it under this policy.

3. How we use it

To respond to your request, prepare your quote and schedule the callback you asked for.
To contact you by phone, text, email or WhatsApp about your project, on the terms of the consent in section 4.
To run, secure and improve this website, including preventing spam, fraud and abuse, and understanding which parts of the site are used.
To keep records of our work, our communications and your consent.
To comply with law, respond to lawful requests, and establish or defend legal claims.
With your consent, to send you marketing about our services. You can withdraw that consent at any time.
For any other purpose we describe to you at the time we collect the information.

We do not use your personal information for automated decisions that have legal or similarly significant effects on you, and we do not use it to profile you for such decisions.

4. Consent to calls and texts

Our quote form asks you to check a box before you send it. Checking that box means you agree to the following, which is your express written consent under the TCPA:

By checking this box and submitting this form, I give BuildWise Pro my express written consent to contact me about my project at the phone number and email I provided, including by calls and text messages that may be sent using automated technology or prerecorded messages. I understand this consent is not a condition of any purchase, that message and data rates may apply, and that I can reply STOP to any text to opt out.

Consent is not a condition of buying anything from us. You can call us instead at any time.
You can withdraw your consent at any time by replying STOP to any text message, by telling the person who calls you, or by contacting us using section 16. We will honor a request to stop within a reasonable time and in any case within ten business days, and we will keep your number on our internal do-not-call list so you are not contacted again.
We honor the National Do Not Call Registry for any call that is not covered by your consent or an existing business relationship.
If a form on this site tells you that your request may be shared with partner contractors, and you consent to that at the form, your consent extends to the partners named or described there. Each partner is responsible for its own compliance with the TCPA and must honor your opt-out.
We keep a record of your consent: the wording you agreed to, the date and time, and the information you submitted.

5. How we share it

We share personal information only in the ways described here.

Service providers

Companies that host this website, store our database, deliver email and text messages, and provide similar services on our behalf. They may use your information only to provide those services to us.

Partner contractors, only if a form tells you so

Today we do our own work and keep every request for ourselves. We may in future offer to connect you with other licensed contractors for work we do not perform. If we do, the form you submit will say so before you send it, will name or describe the partners, and will ask for your consent. Only then will we share or sell your contact details, property details and project details with those partners so they can contact you about your project. Under California law this counts as a “sale” or “sharing” of personal information, and you may opt out at any time under section 7. Partners receive your information under written terms that limit their use of it to responding to your request and complying with law.

Legal, safety and business transfers

To comply with law, a court order, a subpoena or a lawful government request.
To protect our rights, our property, our customers or the public, including to prevent fraud.
To professional advisors such as lawyers, accountants and insurers under a duty of confidentiality.
As part of a merger, acquisition, financing or sale of all or part of our business, in which case this policy continues to apply to your information.

With your direction

When you ask us to share information with someone, for example a co-owner of the property.

We do not sell personal information of anyone we know to be under 16 years of age. In the twelve months before the effective date above, we did not sell or share personal information as those terms are defined by the CCPA.

6. Cookies and Global Privacy Control

This site sets no advertising cookies, no third-party analytics cookies and no tracking pixels. The usage events described in section 2 are recorded by our own server into our own database and are not shared with advertising networks. Your browser may store a small amount of data we need to keep the form working while you fill it in.

We treat a Global Privacy Control signal from your browser as a valid request to opt out of the sale or sharing of your personal information for the browser that sends it, to the extent any such sale or sharing takes place. Because we set no tracking cookies, there is currently nothing further for such a signal to switch off. If we add cookies or tracking in future, we will update this section and ask for any consent the law requires before they are set.

7. Your privacy rights

Depending on where you live, you may have some or all of the following rights over your personal information. We extend the same rights to every U.S. resident regardless of state.

To know whether we process your personal information and to access it.
To receive a copy of the personal information you provided, in a portable format.
To correct inaccurate personal information.
To delete personal information we hold about you, subject to legal exceptions such as records we must keep of work performed or of your consent.
To opt out of the sale or sharing of your personal information, of targeted advertising, and of profiling that produces legal or similarly significant effects. Use the link "Do Not Sell or Share My Personal Information" in the footer of every page, or contact us under section 16.
To limit the use of sensitive personal information. We do not collect sensitive personal information as defined by the CCPA.
Not to be discriminated against for exercising any of these rights. We will not deny you service, charge a different price or provide a different level of service because you exercised a right.

How to exercise your rights

Email us at chaim.k@buildwise-pro.com with the subject line “Privacy request”, or call us at (619) 455-5598. Tell us which right you are exercising and the name, phone number and email address you used with us, so we can find your records. We will confirm receipt within ten business days and respond within 45 days; if we need more time, we will tell you why and respond within a further 45 days.

Verification and authorized agents

To protect your information we verify requests by matching the details you give us against the details in our records, and we may ask you to confirm the request from the email address or phone number on file. An authorized agent may make a request on your behalf if they give us your signed written permission and we can verify your identity; a court-appointed conservator or a person holding a power of attorney need only show that authority.

Appeals

If we decline your request, we will tell you why. You may appeal within 60 days by replying to our decision with “Appeal” in the subject line. We will answer your appeal in writing within 45 days. If we deny your appeal, you may contact your state attorney general; in California, the California Privacy Protection Agency.

8. California notice at collection

This section is our notice at collection under the CCPA and applies to California residents. The table lists the categories of personal information we collect, examples, and whether and to whom we disclose each category for a business purpose. We collect each category from you directly and from your device, for the purposes in section 3, and we keep each category for the periods in section 11.

Sale or sharing: we did not sell or share personal information in the preceding twelve months. If a form asks for your consent to share your request with partner contractors and you give it, the categories marked above may be sold or shared with those partners from that point on, and you may opt out at any time using the footer link "Do Not Sell or Share My Personal Information".
Sensitive personal information: we do not collect it, so the right to limit its use does not apply.
Minors: we do not knowingly sell or share the personal information of consumers under 16.
Financial incentives: we do not offer financial incentives in exchange for personal information.
Shine the Light (Civil Code 1798.83): we do not disclose personal information to third parties for their own direct marketing purposes. You may ask us to confirm this once a year using the contact details in section 16.
Metrics: we will publish the number of requests we received, granted and denied in the prior calendar year if we ever handle the personal information of 10,000,000 or more consumers in a year.

9. Other state privacy laws

Residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia have rights under their state privacy laws that match the rights in section 7, including the right to appeal our decision in section 7. Where a state law sets a shorter deadline or a broader right than described here, we follow the state law. We do not sell personal information, process it for targeted advertising, or profile you in furtherance of decisions that produce legal or similarly significant effects, except for the consented partner sharing described in section 5, which you may opt out of at any time.

Oregon and Minnesota residents may also ask for the list of specific third parties to which we have disclosed their personal information; Minnesota residents may also question the result of any profiling. Maryland residents: we do not sell sensitive data and we do not process the personal data of anyone we know to be under 18 for targeted advertising or sale.

10. Nevada residents

Nevada law lets residents opt out of the sale of certain personal information. We do not currently sell personal information as Nevada defines it. Nevada residents may register their preference in advance by contacting us under section 16 with “Nevada opt-out” in the subject line.

11. How long we keep it

Quote requests and the consent record attached to them: for as long as we may need them to serve you and to prove consent, which is at least five years from your last contact with us, and longer if work is performed, in line with California construction record-keeping and contract limitation periods.
Usage events: up to 24 months, after which they are deleted or aggregated so they no longer identify you.
Communications by phone, text, email or WhatsApp: for the life of the customer relationship and any period the law requires afterwards.
Do-not-contact records: indefinitely, because we need them to keep honoring your request.

When a retention period ends we delete the information or de-identify it. We may keep information longer where the law requires it or where it is needed to establish, exercise or defend legal claims.

12. Security

Your form submission travels over an encrypted connection and is stored in a database that is configured so the public key used by this website can write a request but can never read the customer list back. Access to that list is limited to the people who need it to respond to you. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, and we ask you not to send us information you consider sensitive through the website. If a security incident affects your personal information we will notify you as the law requires.

13. Children

This website is for adults arranging work on a property. It is not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact us under section 16 and we will delete it.

14. Links to other sites

The site links to WhatsApp so you can message us. WhatsApp is operated by a third party under its own privacy policy, which applies to anything you send through it. We are not responsible for the privacy practices of other sites or services.

15. Changes to this policy

We will update this policy when our practices change, and always before we begin any sale or sharing of personal information. The effective date at the top tells you when it last changed. Where a change materially affects how we use information we already hold, we will tell you by email or by a notice on the site before it takes effect.
